US Supreme Court Set to Overturn Roe Vs Wade in Leaked Court Documents

In 2020 Tomi Arayomi prophesied about the current furor of the leaked documents from the US Supreme Court. These documents show that the historic case maybe set aside. The justices in an initial draft majority opinion are set to overturn the ruling of Roe versus Wade. This landmark case has set the tone for subsequent rulings on the right to abortion for almost fifty years in the USA.

On January 22 1973 in a 7-2 vote the Court ruled that unduly restrictive state regulation of abortion was unconstitutional.  Justice Harry A. Blackmun wrote in a majority opinion that a set of Texas statutes criminalizing abortion in most instances violated a woman’s constitutional right of privacy, which it found to be implicit in the liberty guarantee of the due process clause of the Fourteenth Amendment (i.e. “nor shall any state deprive any person of life, liberty, or property without due process of law”).

The leaked draft written by Justice Samuel Alito states, “Roe was egregiously wrong from the start. Its reasoning was exceptionally weak, and the decision has had damaging consequences. And far from bringing about a national settlement of the abortion issue, Roe and Casey have enflamed debate and deepened division. It is time to heed the Constitution and return the issue of abortion to the people’s elected representatives

This ruling was drafted in February and its immediate impact would be an end to a federally constituted protection of abortion rights and let each state decide to either bring an end to it or modify it. Chief Justice John Roberts of the Court has lamented the breach of the Court’s confidentiality and that this would not compromise the integrity of operations in the institution. He also said that an investigation would be conducted. The justice also emphasized that the draft opinion does not represent a decision by the Court or the final position of any member on the issues in the case.”
